On Saturday, released settlement details disclosed that as part of their apology, ABC will also post a note of regret for the false claim on their website and further contribute $1 million towards Trump’s legal costs. It is worth pointing out that Stephanopoulos’ comments, made during a conversation with Rep. Nancy Mace of South Carolina, were misleading given the results of Carroll’s two cases against Trump. In the first finding last year, Trump was held liable for assaulting and defaming Carroll, resulting in her being awarded $5 million in damages. A follow-up defamation case in January saw Trump ordered to pay Carroll an additional $83.3 million. Trump has presently appealed both these rulings. It’s essential to understand, however, neither judgement specified any legally established proof of rape as per the New York law. The court under Judge Lewis Kaplan clarified that the decision made by the jury was primarily influenced by Carroll’s failure to provide sufficient evidence to prove rape against Trump, based on a specific provision in the New York Penal Code. Kaplan highlighted that the criterion for proving rape under this law was narrower as compared to the general conception of the term or the definitions in other state or federal criminal laws. However, Kaplan confirmed this did not suggest that Carroll was incapable of proving she was violated by Trump, as generally understood.
